A selective licensing scheme in Barnsley was approved in February 2018. This followed a period of statutory consultation on the scheme. After this, landlord groups made approaches to us to ask that we use a different approach.
The final 'hybrid' scheme that was brought before cabinet attempted to achieve a compromise. This meant that landlord representatives were allowed a part of self governance.
Once granted, one of the landlord groups challenged the:
- proposal
- process followed
- criteria and evidence presented
We sought legal advice and this confirmed we had followed due process.
Various challenges and Freedom of Information (FOI) requests caused further delays. Due to this, it was felt that the evidence originally presented to justify a scheme could be seen to be outdated. For this reason, the current scheme is no longer being taken forward.
We're looking at the option of more up to date data to implement a scheme.
